MASSACHUSETTS EXPANDS EXCEPTION TO THE BLUE LAWS

The Commonwealth’s arcane Blue Laws prohibit work on Sundays and holidays, unless the employer falls within one of 55 exceptions (including the exception for retail employers) or obtains a permit from the local police chief. Effective August 10, 2016, the Blue Laws were amended to modify an existing exception allowing the “transport of goods,” to expressly cover “delivery” of goods in commerce, as well as the acts connected to the delivery of the goods, such as operating all facilities and warehouses, and the work of loading and unloading goods. Given the complexity of the Blue Laws, please be sure to consult with legal counsel if your business is open or employees work on Sundays or holidays in Massachusetts.
