Scott McConchieScott is an experienced civil litigator with a focus on commercial and employment litigation. He regularly appears in state and federal court, representing large corporations and financial institutions, small businesses, as well as individuals. Scott also has experience in bar disciplinary proceedings, and often is engaged by national law firms seeking local counsel in Massachusetts. Scott’s approach to litigation is collaborative; he works with – and not simply for – his clients in developing creative and pragmatic solutions to the problems his clients face.

In 2015, Scott was appointed to be a Hearing Committee Member for the Board of Bar Overseers (BBO) of the Supreme Judicial Court. The Hearing Committees are fact-finding tribunals in disciplinary proceedings; as such, they hear testimony, take evidence, make adjudicatory rulings, and prepare a written report and recommendation for the Board of Bar Overseers.

Prior to joining Manchel & Brennan, P.C. in 2016, Scott spent three years at Sherin and Lodgen, where he was a partner in the Litigation Department. Scott began his career at Choate Hall & Stewart, where he was a member of the litigation and employment law departments, and then practiced for almost thirteen years at the Boston litigation boutique Griesinger Tighe & Maffei.

Representative Experience

  • Represent LLC and manager-members in alleged freeze out. Successfully cross-moved for preliminary injunction, thereby preventing ousted plaintiff from competing with LLC. Case settled favorably thereafter.
  • Represented a number of out-of-state moving companies in action against website that manipulated third-party reviews. Case resulted in favorable settlement at mediation.
  • Represented hospital in dispute over royalties due to it under a “most favored nations” clause in patent license agreement. Case settled for $20 million.
  • Successfully defended foreign bank and brokerage firm in action alleging, inter alia, fraud and securities violations. Case dismissed on jurisdictional grounds.
  • Obtained summary judgment for law firm client in dispute with former partner over post-separation contingent fee.
  • Successfully moved to dismiss complaint against internet services provider pursuant to Communications Decency Act.
  • Represented attorney in coverage action against malpractice insurer. Case successfully resolved with global settlement of malpractice and coverage claims.
  • Represented specialty paper manufacturer in breach of contract litigation against consultant for botched software standardization project. Case resulted in favorable settlement.
  • Defended engineering firm in wrongful death litigation related to “Big Dig” ceiling collapse and in related property damage case brought by the Commonwealth of Massachusetts. Both cases settled favorably.
  • Obtained dismissal of complaint against Caymanian builder, who had constructed multi-million dollar vacation home for Massachusetts plaintiff. Obtained dismissal of subsequent complaint on res judicata grounds, and successfully moved for award of all attorneys’ fees as a Rule 11 sanction.
