Ms. Eckstein focuses her practice on the representation of businesses involved in complex commercial litigation. She has a wide range of experience representing clients in complex civil litigation and employment-related disputes, including administrative agency hearings and appeals before the Civil Service Commission, and trial and appellate practice in the state and federal court systems. Diana counsels clients and litigates disputes in all areas of commercial law, including breach of contract, breach of fiduciary duties, partnership dissolution, fraud and unfair trade practices under Massachusetts General Law c. 93A. She has provided opinions and drafted company policy guidelines to protect her corporate clients from increased liability by way of impending legislation, and has represented municipal clients at the state, provincial, territorial, regional or local levels.
Diana has also focused extensively on initiatives seeking to educate and assist attorneys to develop guidelines and policies that address the legal impact of technological development on ways of doing business. Diana has been on the forefront of the burgeoning field of privacy law, an area of law that largely effects B2B and B2C transactions. Diana has represented clients in invasion of privacy disputes, including data breaches, electronic privacy protection and invasion, social security and identity theft, and disclosure and/or impermissible use of protected health information under HIPAA. Diana is a founding member of the Privacy Law Committee of the Boston Bar Association, and has presented and moderated seminars addressing employee and workplace privacy in the world of high technology. In furtherance of her ability to address and limit her clients’ exposure to liability in ecommerce, Diana is currently earning her Masters Degree in Computer Science at the University of Massachusetts Boston.
Before joining Manchel & Brennan, P.C., Diana worked as a Civil Litigation Associate at a firm in Boston, Massachusetts, representing clients on a wide range of breach of duty, breach of contract, malpractice, and negligence disputes.
