Brian LamkinMr. Lamkin focuses his practice on the representation of businesses, both large and small, regarding their employment law needs.  He counsels clients on a wide range of employment-related issues, including hiring, discipline and termination of employees; enforcement of trade secrets, and non-competition, non-solicitation and non-disclosure agreements; wage and hour laws; family, medical and military leave; prevention and investigation of claims of discrimination and harassment; and techniques for avoiding employee lawsuits and administrative claims.  Brian also has extensive experience representing employers in state and federal trial and appellate courts and before administrative agencies, as well as in alternative dispute resolution proceedings such as mediation and arbitration.  Additionally, Brian provides training on employment law and human resource issues to both management and non-management employees; prepares and reviews employment, severance and non-competition agreements, employee guidebooks and human resource policies; and writes and lectures on employment-related topics.

Before joining Manchel & Brennan, P.C., Brian spent ten years practicing in the Labor and Employment and Litigation groups at Edwards & Angell LLP (now Edwards Angell Palmer & Dodge LLP).  Prior to Edwards & Angell, Brian practiced at the Baltimore, Maryland firm of Smith, Somerville & Case, L.L.C.

In June 2009, the Massachusetts Appeals Court upheld the dismissal of a former employee’s discrimination and assault claims against one of the firm’s clients.  Brian Lamkin originally obtained the dismissal in Superior Court before any discovery had been taken, then convinced the Appeals Court to affirm the dismissal, which it did “for substantially the reasons set forth in [the client’s] brief.”  As a result, the client was able to avoid lengthy and expensive discovery and a trial.
